Yes, it is true that psilocybin mushroom spores are only illegal in the US in California and Georgia. Federally, and in every other state, the spores themselves are not illegal. We have a new page with information about this at:

There is little data about whether law enforcement agencies go to any trouble to try to track spore containing packages going into those states. The most likely troublesome scenario would be one where a spore supplier were arrested (for whatever reason) and their records seized. In such a case, it isn't hard to imagine records for customers from California or Georgia being given to law enforcement in those states.
Most spore suppliers won't send spores into states where it is illegal.
