Are 5-MeO-DIPT or AMT scheduled/illegal in Canada?
Q: I searched through the Canadian controlled drugs & substances act but couldn't seem to find what I was looking for. My question is, are 5-MeO-DIPT or AMT scheduled?

A: To the best of our knowledge, 5-MeO-DIPT and AMT are not scheduled in Canada. The U.S. almost always leads Canada in making new substances illegal and these two chemicals are only in the process of being emergency scheduled in the U.S. right now (Mar 2003). This means that in the strictest sense, 5-MeO-DIPT and AMT are not illegal to possess in Canada.



Now it may be possible for possession of an unscheduled substance to be prosecuted under legislation similar to the U.S. Analogue Act. But I'm not familiar enough with Canadian law to know how likely this is.



Unfortunately, it's also possible to have any white powder or small tablet confiscated by the police who may *believe* that it's an illegal substance. We've heard several stories (mostly from the U.S.) about people who have had various amounts of research chemicals such as 5-MeO-DIPT or AMT confiscated. Only in one case were charges pressed and this was due to the fact that the individuals in question were purportedly packaging and selling 5-MeO-DIPT as "Ecstasy" along with other "Ecstasy" tablets which contained MDMA (which IS a scheduled substance).



Hopefully this helps clarify at least a little.
