Is Banisteriopsis caapi illegal to import?
Q: The vault on banisteriopsis caapi says that this is not really scheduled in the u.s. but anything contaning dmt is considered illegal..Does b. cappi contain dmt.? I have found a place in the netherlands that will ship it... But i don't wanna get arrested and would like to know for sure if it legal or not?

A: Banisteriopsis caapi does not contain DMT. It contains harmine/harmaline which are not scheduled in the United States. There are no laws which would make importing, possession, or sales of dried B. caapi illegal (importing live plants involves the department of agriculture and is a more complex issue). Chances are that everything would go fine with an order, but unfortunately this doesn't necessarily mean that customs won't seize it as it crosses the border.



Because customs and the DEA are not very knowledgeable about the more obscure plants, they may seize packages based on the source company. There should be no legal concern about this as B. caapi is not an illegal plant or substance, but it is possible that they could seize the shipment and send a note to you saying they've seized a questionable package. At that point you have two options which are to either ignore the message and lose the package or respond to the message and go through the process of explaining what the contents are and that they are not illegal. Again, chances are this won't happen to you, but it is possible.
