Is Salvia divinorum going to become illegal?
Q: Is it likely that Salvia divinorum will become illegal anytime soon? Also, do you have to be a certain age to be able to possess it like you do with tobacco?

A: There is no way to know if or when Salvia divinorum will be made illegal in the U.S. As of April 2002, there has been no public notice that the DEA or the Attorney General plans to schedule S. divinorum. It is likely that if it is ever scheduled, it will happen quickly and without much warning through the emergency scheduling process.



There are no age limits on possessing Salvia divinorum, though state regulations in some places could potentially prevent stores from selling it to minors since it is intended to be smoked. However we are unaware of any such laws. Generally age limits on tobacco purchases specifically name tobacco, rather than any smoked product. Check your local laws.
